Dubai: A businessman lost his appeal and will spend a month in jail for cheating on his wife and having sex with a stranger which was detected by his stepson.
The Indian stepson was using his mother’s laptop at home when he came across several obscene images of his countryman stepfather along with an unidentified woman performing oral sex on him. He also saw photos of his stepfather involved in different sexual activities with the stranger in April 2015.
The Indian wife lodged a complaint with the police. When confronted with his wife’s complaint and the images, the businessman denied the accusation of having been involved in any relationship with the unknown woman.
In August, the Dubai Misdemeanours Court sentenced the defendant to one month in jail followed by deportation.
The defendant appealed the primary judgement before the Appeal Court and renewed his not guilty plea.
He argued before the appellate court that the wife’s allegations were fabricated.
Meanwhile, his lawyer asked the court to dismiss the case citing time lapse.
Appellate court’s presiding judge Adnan Al Farra rejected the defendant’s appeal and upheld his one-month imprisonment.
The deportation order was also upheld.
According to the appellate court judgement, the forensic evidence report confirmed that the defendant had had consensual sex with a stranger and that the claimant’s [wife’s] statement was true.
An arrest warrant has been issued against the defendant, who is now wanted by law enforcement authorities to execute the ruling.
Presiding judge Al Farra also confirmed the primary court’s judgement in which the defendant has been ordered to pay Dh21,000 in compensation to his wife.
On the other hand, the defendant contended that his wife and stepson had photoshopped his photos with that woman, whom he claimed he did not know, due to a pending divorce case between the litigants [businessman and wife] at Dubai courts.
According to the charge sheet, the Indian businessman was accused of having oral and consensual sex with the unidentified woman and exchanging kisses with her.
The defendant had contended that the images had been tampered with and fabricated using a special software.
The seized images were earlier referred to Dubai Police’s forensic laboratory that examined the photos and confirmed that they had not been photoshopped or fabricated.
The stepson said he was using his mother’s device when he found images of his stepfather naked along with the unknown woman in bed together.
There were also other images of the accused with women in bikinis in a pool, testified the stepson.
