Abu Dhabi: Workers who sustain injuries while performing their job while complying with all stipulated procedures must be compensated by their employer, the Judicial Department of Abu Dhabi said on Monday.

Employers must pay if it is proved in court that workers were injured as a result of negligence or a personal mistake on their behalf, or due to their failure to provide their employees with a safe working environment, the Civil Court held.

Last year, Gulf News reported that a company was ordered to pay the next of kin of two workers Dh400,000 in addition to Dh10,000 after they died due to asphyxiation on inhaling poisonous gas after the industrial facility failed to provide gas masks and oxygen tanks.

However, in respect of other work-related accidents that occur within the place of employment, the compensation will be deliberated by a committee at the Ministry of Labour that will make a decision according to the UAE Labour Law.

These clarifications were issued during a case filed by a worker who sustained a fall while climbing a metal ladder in a bid to paint one of the walls at his company. Investigations revealed that the company concerned had put in place all safety measures and the plaintiff finally withdrew his complaint and his employer paid for his treatment.
