Dubai: An inmate has been cleared of sneaking into his fellow cellmate’s bed and having sex with him shortly after he took his medication and slept at Dubai Central Jail.

Citing lack of corroborated evidence, the Dubai Court of First Instance acquitted the Emirati inmate of jumping into his countryman’s bed and raping him while the latter was under the influence of a strong medication in October 2013.

The inmate pleaded not guilty and strongly refuted what he described by unfounded and baseless accusations that he had sex with the cellmate.

According to the charge-sheet, prosecutors claimed the suspect exploited the fact that the 23-year-old claimant [who suffers a psychological illness] had taken his medicine and was asleep when he was raped.

The cellmate claimed to prosecutors that he was under the influence of five medicines when the incident took place.

“I slept around 1.30am… around 4am I woke up feeling pain and spotted the suspect sleeping behind me. I discovered that the suspect had sex with me while I slept. When I confronted him, he immediately denied it,” claimed the 23-year-old.

Dubai Police’s forensic examiner testified to prosecutors that the suspect’s DNA matched those lifted from his cellmate’s underwear.

Wednesday’s ruling remains subject to appeal within 15 days.
