Dubai: A wife and her lover are challenging a three-month imprisonment that they were handed after the woman’s husband exposed the couple committing adultery in their love den.

Earlier this year, the Dubai Misdemeanours Court sentenced the Lebanese wife (who’s also facing a divorce lawsuit lodged by her countryman husband) and the Lebanese man to three months in jail for having unmarried sex.

They were also handed a deportation order.

The Lebanese defendants entered a not guilty plea and asked the court to dismiss their charges contending that law enforcement procedures were carried out illegally against them.

Law enforcement officers raided a flat that the Lebanese couple, who are in their 30s, had rented in Dubai Silicon Oasis and arrested them after the husband had complained that his wife had been cheating on him with his best friend.

In his police complaint, the husband claimed that he and his brother monitored the wife for a period of time before they located the rented flat where the couple had been indulging in their adulterous relationship.

After having located the building and the flat in which the couple had been having unmarried sex, according to the husband’s complaint, the latter said he saw the defendants naked and in a compromising situation from an adjacent building under construction.

The complainant claimed that he and his brother went to the adjacent building to a floor the same level as the rented flat and saw the defendants together.

The husband also claimed that he had seen the defendants, while monitoring them, go into a hotel where he alleged they spent time together.

At the time when law enforcement officers raided the flat as per prosecutors’ warrant, a condom, underwear and other items that were reportedly used by the couple were confiscated.

According to court records, Dubai Police’s forensic report confirmed that the seized items had traces of semen and DNA that belonged to the Lebanese couple.

Meanwhile the arresting officers testified before the primary court that the couple confessed to having unmarried sex during questioning.

However the couple maintained their innocence and strongly refuted their charges.

The Misdemeanours Court also referred to the Dubai Civil Court, the husband’s civil lawsuit and in which he is seeking Dh200,000 in temporary compensation.

When the defendants showed up before the Dubai Appeal Court, they entered an innocent plea and firmly denied the charge of having unmarried sex.

The defendants have challenged their primary sentence and have asked the appellate court to overturn the ruling and acquit them.

The husband’s divorce and civil lawsuits are pending trial.
