Dubai: A guard lost his appeal and will be jailed for a month for biting the parents of a college student, who alleged that he had molested her in a gated community’s gym.
The woman lives in the gated community with her parents.
In August, the 37-year-old Pakistani guard allegedly entered the gym behind the 21-year-old Indian woman and told her that it was closing time since it was 9pm.
When she was about to leave, she claimed that the guard tried to hug and grope her. She resisted him, rushed out and called her parents for help.
When the woman’s father tried to restrain him and call the police, the guard allegedly bit him. He also bit the mother’s finger when she intervened.
On Wednesday, the Dubai Appeal Court upheld the defendant’s one-month imprisonment and fined him Dh1,000 for biting the fingers of the woman’s parents.
However, the court upheld his acquittal on the charge of molesting the girl.
The guard had denied the molestation charge, but had admitted to assaulting the parents.
Prosecutors had accused the guard of abusing the fact that the girl was exercising in the empty gym when he tried to hug and grope her. When she pushed him away and sought the help of her parents, he bit the fingers of her father and mother, they said.
The girl had claimed that the guard suddenly locked the door from inside and attempted to molest her when she was about to leave.
The ruling remains subject to appeal before the cassation court within 30 days.
