Dubai: A man was cleared of confining a woman in his flat and trying to rape her and threatening to kill her.

Meanwhile, the 37-year-old Emirati man, A.J., was sentenced to three months in jail for assaulting the Kyrgyz woman and putting shisha charcoal on her stomach after she rejected his sexual advances in January.

The Dubai Court of First Instance also fined A.J. Dh2,000 for consuming alcohol.

The defendant pleaded not guilty and denied all charges except drinking alcohol.

However A.J. is expected to be released from prison soon considering that he has spent more than seven months behind bars.

When he entered his innocent plea, he told the court: “I did not confine her in my home. Prosecutors brought unfounded and baseless accusations against me just to coerce me to confess to crimes I did not commit. This case is based on lies … the woman willingly came to my house. I did not even attempt to rape her. She lied about that.

“I have been treated unjustly. Prosecutors refused to hear my defence witness. Actually she is the one who assaulted me first. She threw a liquor bottle at my head and almost killed me. I did not slap or beat her … I was defending myself. She fabricated all these baseless allegations. I have been in detention for something I did not do,” he said.

Citing lack of corroborated evidence, presiding judge Urfan Omar cleared A.J. of a rape bid, confinement and threat. He was jailed three months for assault and fined for drinking.

Prosecutors said the defendant locked the Kyrgyz woman in his house and used physical violence in his attempt to rape her.

The woman claimed to prosecutors the incident happened when she visited A.J.’s residence along with her Kyrgyz friend.

“My friend is a friend of the defendant as well. We went to the latter’s flat at 2am in Bur Dubai. The defendant and a companion of his were there. We stayed for 30 minutes and then my Kyrgyz friend and the suspect’s companion went out … I tried to go with my friend, but he told me that he would be back in a few minutes. The suspect locked the door. He made me drink alcohol. When I tried to refuse, he sprinkled liquor in my face. He forced me to drink. Then he assaulted me … I fought him and foiled his attempt to have sex with me. Then he went to sleep and took me to bed with him. We both fell asleep … I woke up in the morning and looked for my mobile. I called up the police,” claimed the woman.

The primary ruling remains subject to appeal within 13 days.
