Dubai: A truck driver has been jailed for three months for fracturing his colleague's arm because he refused to let him take a nap during work.

The Dubai Court of First Instance convicted the 29-year-old Pakistani driver, F.H., of beating his 53-year-old countryman, O.S., and causing permanent disability.

"No I did not assault him… I am innocent," argued F.H. when he defended himself in court.

According to the arraignment sheet, prosecutors said F.H. inflicted five per cent permanent disability to O.S.'s arm after he twisted it.

The claimant testified that the incident happened at around 2:30am.

"The defendant asked me to move the consignment and return quickly because of heavy work load. I delivered the goods and returned to the workplace. The defendant wanted to sleep beside his vehicle. I walked up to the defendant and asked him to load the products on the truck in order to deliver the consignment. Immediately he refused and said he won't do that because he was fatigued and wanted to sleep.

Fatigued

"I told him I was fatigued as well… but I returned early to help him in his work. Suddenly he pulled me by my arm and threw me down to the ground. Then he twisted my arm behind my back and broke it. I was taken to hospital for treatment," O.S. claimed during questioning.

Medical reports confirmed that O.S. sustained five per cent disability in his hand and fingers.

Sunday's judgment is subject to appeal within 15 days.
